# ArcVelvet Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ArcVelvet platform (“ArcVelvet,” “we,” “us,” or “our”). By accessing or using ArcVelvet, you agree to be bound by these Terms.

## 1. Platform Overview

ArcVelvet is a creator platform that surfaces content and interactions through a deterministic, signal-based system (“Console + Sky”).

Content visibility, ordering, and interaction are governed by platform-defined ranking and mapping systems. ArcVelvet does not guarantee content reach, discoverability, or audience outcomes.

## 2. Eligibility & Age Verification

ArcVelvet requires users to be at least 13 years old. Users under 13 are not permitted to create accounts per COPPA regulations. If we discover a user is under 13, the account is immediately deleted and all data purged within 48 hours.

Users aged 13-17 require verified parental consent before using interactive features (posting, messaging, following). Parents must provide their email address and consent to their minor's account.

Users 18+ may self-declare their age at signup and must accept the Terms of Service and Privacy Policy. Verified Creator status and monetization features require additional government ID verification.

## 3. Minor Protections

- Minors cannot be direct-messaged by adult users. This restriction is structural and cannot be bypassed.
- Minors can only message other minors within their own age band (13-15 or 16-17).
- Minors are not searchable by default. Discovery is opt-in.
- Minors cannot receive monetization until age 18.
- Parents linked to minor accounts receive notifications about account activity and can request account deletion.

## 4. Account Deletion (user-initiated)

This section governs user-initiated deletion. For platform-initiated termination (suspensions for violations), see Section 21. The AE-balance treatment differs between the two paths.

You may request account deletion at any time from your account settings. Deletion is scheduled 30 days in the future; you may cancel during the grace window from the same settings surface.

When the 30-day window elapses, the following happens on the scheduled deletion date:

**AE balance disposition.**

- **Withdrawable AE** (the source-tracked subset earned from other users): we attempt to pay this to your registered Stripe Connect account. If the payout succeeds, the funds are sent to your registered bank. If the payout fails for any reason (no Stripe Connect account on file, Stripe payouts disabled on your account, sub-minimum balance, Stripe API failure), the withdrawable balance is moved to a deletion-escrow record and held for **12 months**. During that 12-month window you may recover the balance through the recovery flow described below. After 12 months, any unrecovered escrowed funds are forfeit to the platform.
- **Non-withdrawable AE** (residual balance — platform-issued credit, pack-purchased AE, trial balances): forfeit on the deletion date. Recorded as a ledger entry for audit but not paid out.

**Content disposition.**

- **Posts with at least one associated sale** are preserved. Your display name is replaced with "Account Deleted" so buyers can continue to verify their purchases through the public verifier endpoint. The cryptographic claim embedded in each signed file still carries your original name (it cannot be modified post-hoc without invalidating the signature); the "Account Deleted" replacement is an application-layer presentation choice only.
- **Posts with no sales** are deleted along with your account.
- **ARC-signed items** are always preserved, with your vendor name replaced by "Account Deleted" for the same reason: the chain-of-custody record stays intact for buyers and chained signings, but the platform stops associating it with a live account.
- **Sale records** you participated in (as seller or buyer) are preserved indefinitely so the counterparty can continue to verify the transaction.

**Stripe artifacts.** On the deletion date, the platform best-effort closes your Stripe Connect account and your platform-side Stripe customer record. If Stripe rejects either call (e.g., pending payouts on the Connect account), the cleanup is logged for manual review; the rest of the deletion proceeds regardless. Your broader Stripe identity persists outside the platform if you have one.

**Recovery flow for escrowed balances.**

If your withdrawable AE was escrowed on deletion (because payout failed), you can recover it within the 12-month dormancy window by visiting the recovery page and supplying:

1. The email address that was associated with the deleted account, and
2. A new Stripe Connect account id (created out-of-band) as the payout destination.

We email a one-time recovery token to the registered email address. After you supply the token plus the destination, we pay the escrowed balance to the new destination and close the escrow record. Tokens expire after 24 hours; recovery attempts are rate-limited per email. After the 12-month window the escrow is absorbed to platform revenue and is no longer recoverable.

**Other data deleted on the cascade.** Your profile, wallet rollup, FCM push tokens, follows you initiated, world record, creator marks, and Firebase Authentication user are all deleted along with the account. Ledger entries (currency_transactions) are preserved as an immutable audit trail; they reference your deleted uid but no longer surface publicly.

**Minors.** For accounts linked to a parent, the parent is notified when deletion is requested.

## 5. Accounts

You are responsible for maintaining the confidentiality of your account and for all activities conducted under your account.

ArcVelvet reserves the right to suspend or terminate accounts at its discretion.

## 6. Payments & Stripe Integration

All payments are processed through Stripe Connect.

- Payments are made directly from users to creators
- ArcVelvet collects platform fees at the time of transaction
- ArcVelvet does not hold or custody funds

Stripe processing fees are charged separately by Stripe.

## 7. Platform Fees

**How fees work**

ArcVelvet charges a platform fee at the time a creator withdraws earnings to their bank account. Tips, drops, and in-platform transactions carry no platform fee — 100% of the AEYE received is credited to the creator's wallet.

**Standard Creators**
- 10% platform fee deducted at withdrawal
- Tips received: 0% fee (full AEYE amount credited to wallet)
- Drops received: 0% fee
- Content rights purchases: 5% (applied at withdrawal)

**Founding Creators (first 50 slots)**
- 0% platform fee for 120 days from grant date
- Standard fees apply after the 120-day window expires

**ArcVelvet Revenue Model**

ArcVelvet earns revenue primarily from the USD → AEYE conversion (AE purchase packs). The spread between the purchase price and the redemption rate constitutes platform revenue. The withdrawal fee supplements this.

ArcVelvet reserves the right to modify fees at any time with reasonable notice.

## 8. AEYE Virtual Currency

AEYE is a platform-scoped virtual unit.

- Purchasable with USD
- Current rate: $0.02 per AEYE (subject to change)
- No independent cash value
- Non-transferable outside ArcVelvet

All AEYE activity is recorded as CurrencyTransactions.

Creators may receive payouts derived from AEYE interactions through Stripe.

## 9. Stripe Compliance

You agree to comply with:

- Stripe Services Agreement
- Stripe Connected Account Agreement
- Applicable payment network rules

ArcVelvet is not responsible for Stripe account restrictions, holds, or enforcement actions.

## 10. Intellectual Property

Creators retain ownership of their content.

By uploading content, creators grant ArcVelvet a non-exclusive, worldwide, royalty-free license to host, display, and distribute content for platform operation.

## 11. Content Rights & Purchases

Unless otherwise specified:

- Purchases grant limited, non-transferable access
- Ownership of content does not transfer

Creators define the scope of rights granted.

## 12. DMCA / Copyright Policy

ArcVelvet respects intellectual property rights.

If you believe content infringes your copyright, you may submit a notice including:

- Identification of the copyrighted work
- Identification of the infringing content
- Contact information
- A statement of good faith belief
- A statement under penalty of perjury

ArcVelvet may remove or disable access to infringing content and terminate repeat infringers.

## 13. Refund Policy

All transactions are final unless otherwise stated.

Refunds may be issued:

- where required by law
- in cases of fraud or error
- at ArcVelvet’s discretion

Chargebacks may result in account suspension or termination.

## 14. Subscriptions & Cancellation

Subscriptions automatically renew unless canceled.

Users may cancel at any time. Cancellation:

- prevents future billing
- does not refund prior charges unless required by law

Access continues until the end of the billing period.

## 15. User Conduct

Users agree not to:

- violate laws
- infringe intellectual property
- engage in fraud or abuse
- attempt to manipulate platform systems

ArcVelvet may remove content or accounts at its discretion.

## 16. Community Flagging & Dispute Badges

Users can report debate messages and posts as misinformation, deepfake, harassment, or spam. Reports are reviewed by ArcVelvet moderators. Confirmed reports result in a dispute badge applied to the content.

Dispute badges do not remove content. They indicate community concern and moderation review. Creators retain the right to respond to disputes.

False reports may result in account suspension. Serial false reporting can result in a ban.

## 17. Creator Accountability

All content you publish is cryptographically signed with your identity via C2PA provenance. You cannot upload content anonymously. You are responsible for the copyright, accuracy, and legality of what you publish.

## 18. AI-Generated Content

You may publish AI-generated work. You must disclose if content is AI-generated, deepfake, or synthetic media when flagged or requested. Failure to disclose synthetic origin may result in account suspension.

## 19. Chargebacks & Fraud

ArcVelvet may:

- reverse transactions
- suspend accounts
- recover losses caused by fraudulent activity

## 20. Tax Responsibility

Creators are solely responsible for:

- reporting income
- paying applicable taxes
- complying with tax laws

ArcVelvet does not provide tax advice and may report earnings as required by law.

## 21. Termination (platform-initiated)

This section governs platform-initiated termination — suspension or termination at ArcVelvet's discretion for violations or risk to the platform. For user-initiated deletion, see Section 4. AE-balance treatment differs between the two paths: user-initiated deletion (Section 4) attempts auto-payout of the withdrawable portion before any forfeit; platform-initiated termination (this section) voids AE balances on termination.

ArcVelvet may suspend or terminate access at any time for violations or risk to the platform.

Upon termination:

- platform access ends
- AEYE balances are void

## 22. Disclaimers

ArcVelvet is provided “as is” without warranties of any kind.

## 23. Limitation of Liability

To the maximum extent permitted by law, ArcVelvet is not liable for indirect, incidental, or consequential damages.

## 25. Governing Law

These Terms are governed by the laws of Ohio,U.S.A..
